En busca de la legalización perdida

¿Por qué se cree que mediante la prohibición y la represión se pondrá fin al consumo de las drogas? ¿La liberación de las drogas haría más personas toxicómanas? ¿Por qué los gobiernos creen que pueden decirnos qué cosa nos debemos meter al cuerpo y qué no? ¿Cuáles son las consecuencias y a quién beneficia la prohibición? ¿Por qué hay tanta tolerancia social con el alcohol y el tabaco y no con la marihuana?
¿Qué hacer para dar un paso más hacia la libertad y no permitir que la clase política controle nuestras decisiones? ¿Acaso la penalización no agrava la delincuencia y la violencia? ¿El problema son las drogas o las leyes represivas que provocan la creación de mafias, corrupción y muertes? ¿Acaso no sería mejor implementar la despenalización para destruir todos los niveles del narcotráfico y crear un sistema que beneficie social y económicamente al Estado?
La demanda crece, los grandes cárteles y mafias tienen el poder económico y bélico para corromper y amedrentar a todos los que pretendan oponerse a su negocio. El sistema se sigue creando y desarrollando, una cadena que va desde el capo de la organización más poderosa hasta el micro comerciante que la revende y altera su calidad. Las juzgados y las cárceles se llenan de mafiosos, asesinos a sueldo, minoristas de armas, burriers, dealers, paqueteros, agricultores, consumidores y todo aquel que participe en esta cadena -que siempre se romperá por el lado más débil- ¿Y? ¿Se ha logrado algo? Se sigue comerciando en todos los niveles. Las drogas siempre estarán ahí, siempre han estado. Su historia nos ha demostrado que su restricción no ha contribuido a desaparecerlas del quehacer humano.
“La experiencia muestra que disponer libremente de una droga no crea conflictos sociales e individuales comparables a los que provocó y provoca su prohibición” nos dice en su artículo “Prohibición: Principios y consecuencias”, el filósofo y ensayista español, Antonio Escohotado y nos da ejemplos históricos que contradicen los argumentos para la ilegalidad. En el caso de China “la legalización del opio redujo del 160% al 5% el índice de aumento de las importaciones… con la legalidad desapareció la fascinación del paraíso prohibido”. Cuando se estableció la ley seca en Estados Unidos, entre 1919 y 1933, se causó “una enorme corrupción burocrática, injusticia, hipocresía, una gran cantidad de nuevos delincuentes, envenenamientos en masa con alcohol metílico y la fundación del crimen organizado, sin reducir en más del 30% el consumo general”. Escohotado también nos expone ejemplos más recientes como el caso de Holanda, que optó por la legalización de la marihuana y el hachís desde fines de los setenta y donde las autoridades holandesas han constatado que el número de usuarios nativos disminuyó del 20% al 14%. Otros casos de narcóticos legales, como el éter y el cloroformo, se dejaron de consumir significativamente sin ser necesaria su prohibición.
En un documento entregado en la cumbre antidroga de la Asamblea General de Naciones Unidas en 1998, 360 intelectuales de todo el mundo manifiestan que “Persistir en las actuales políticas (de represión) se va a traducir solamente en un mayor abuso de las drogas, en un mayor fortalecimiento del narcotráfico y de los criminales que lo controlan, en más enfermedad y sufrimiento”. En una de sus últimas y más afortunadas columnas en el diario “El País”, el escritor Mario Vargas Llosa defendió la despenalización de las drogas y puso como ejemplo el horror que se vive en México, “es absurdo declarar una guerra que los cárteles de la droga ya ganaron. Que ellos están aquí para quedarse. Que, no importa cuántos capos y forajidos caigan muertos o presos ni cuántos alijos de cocaína se capturen, la situación sólo empeorará. A los narcos caídos los reemplazarán otros, más jóvenes, más poderosos, mejor armados, más numerosos, que mantendrán operativa una industria que no ha hecho más que extenderse por el mundo desde hace décadas, sin que los reveses que recibe la hieran de manera significativa”. Lo que refiere Vargas Llosa no es nuevo, se ha expuesto numerosas veces por varios intelectuales y especialistas en varias instancias de competencias nacionales e internacionales. La prohibición no nos da seguridad ni nos protege, sólo alimenta desgracias. El escenario se vuelve cada vez más hostil, la clase política no comprende que a la droga no se le combate con armas, es urgente una verdadera política para dejar de fomentar la violencia, el terror y el imperialismo de algunos estados oscurantistas.
Según el reconocido psiquiatra, Thomas Szasz, “La guerra contra las drogas no es sino un capítulo más de la historia general de la estupidez humana. Así como reclamamos la libertad de pensamiento para elegir nuestras lecturas o la película que deseamos ver, así como tenemos derecho a meter en nuestras mentes lo que queramos, también tenemos derecho a elegir nuestros alimentos y cualquier otra sustancia que queramos meter en nuestros cuerpos”. La penalización va en contra de la libertad de los individuos, ninguna ley puede decirnos que consumimos y que no ¿Soy un criminal por fumarme tres porros de marihuana todos los días? Estados Unidos, el principal productor de marihuana en el mundo, ha liberado el cannabis para fines terapéuticos en trece de sus cincuenta estados. El año pasado los ex presidentes de Brasil, Fernando Henrique Cardoso; de Colombia, César Gaviria; y de México, Ernesto Zedillo, como líderes de la Comisión Latinoamericana sobre Drogas y Democracia, propusieron la descriminalización de la tenencia de marihuana para su uso personal y un “cambio de paradigmas” que reemplace la ineficaz estrategia contra los estupefacientes. Según el informe final de la Comisión, los estados que practican una política antidrogas, siguen un modelo similar -implantado en la región desde Washington- que se resume en la erradicación de los cultivos ilícitos, el desmantelamiento de los grupos narcotraficantes, la militarización de la lucha antidrogas, la criminalización de toda la cadena interna ligada al negocio de los narcóticos y el rechazo a cualquier iniciativa pro legalización de drogas. Tal modelo, no ha hecho más que provocar un absurdo e inservible continuismo de violencia que ha costado muchas pérdidas humanas y un macro gasto de recursos. La propuesta de estos tres ex presidentes sólo es para la liberación de la marihuana porque, según Cardoso, “hay que comenzar por algún lugar”, pues habría sido “liviano” y “poco realista” pedir lo mismo para todas las drogas. Se escogió el cannabis por su gran implantación en todos los países de la región y porque es “menos dañino”.
Sin embargo, a más de un año de la presentación de este informe, aún no existe una mínima voluntad política para legalizar la marihuana en Sudamérica. En el Perú, la situación no es alentadora, se persiguen por igual a agricultores, micro comerciantes y consumidores (la parte más débil de la cadena). Según el Ministerio del Interior, ocho mil de las doce mil detenciones del 2009 son a consumidores, o sea el 60 %, a pesar de que el artículo 299 del Código Penal Peruano dice que “No es punible la posesión de droga para el propio e inmediato consumo, en cantidad que no exceda de cinco gramos de pasta básica de cocaína, dos gramos de clorhidrato de cocaína, ocho gramos de marihuana o dos gramos de sus derivados, un gramo de látex de opio o doscientos miligramos de sus derivados”. Es decir, no te pueden llevar preso por llevar un troncho de marihuana o un falso de cocaína encima. Pura desinformación. La Asociación Civil “Legaliza Perú” es un proyecto joven que busca eliminar la ignorancia y promover la normalización de las plantas psicoactivas. “Suprimir el vínculo que tiene el usuario con el narcotraficante en el comercio ilegal; terminar con la violencia, represión, extorsión y discriminación a los usuarios; y destruir ese mito puente en donde se dice que la marihuana te lleva a probar otras drogas, son los principales objetivos de Legaliza” nos explica Falto Yeshua, activista de la organización. “Lo primero es eliminar el prejuicio para que la gente no le tema al conocimiento de la planta, con ella podemos fabricar ropa, alimentos, combustible, jabones, papel, cosméticos, tintes; se sabe muy poco de ella y se le prohíbe tanto”. Legaliza Perú ha organizado tres conversatorios y una campaña informativa en universidades y playas, además está convocando a la “Primera Marcha Mundial por la Marihuana”, que se realizará el primero de mayo, “en la marcha no se promueve el consumo de ninguna sustancia o de bebidas alcohólicas, hemos advertido a los usuarios que no fumen en lugares públicos y que la marihuana que lleven sea inferior a 8 gramos, la idea es ir y mostrar tranquilamente que son consumidores”. Falto también nos da su visión de cómo sería nuestra sociedad si se liberara a la marihuana, “la sociedad estaría más segura, ya no habría persecución y delincuencia sino regulación, se sabría aprovechar mejor lo positivo de la planta ¿Por qué niegan algo que no conocen? Lo malo no es la sustancia en sí, sino la sustancia en el hombre, el hombre tiene muchas maneras de actuar bajo los efectos de cualquier sustancia. El estado mismo podría ganar ingresos de los impuestos, viviríamos en un mundo más sincero y habría menos gente que consuma drogas”.
